- 1. General & Disclaimer
1.1. In these Terms & Conditions (“T&Cs”), “We”, “Us”, “Our”, “Legends” means Legends NZ Limited (NZBN 9429050538935). Legends is appointed by NZ Super Rugby Clubs Limited (“NZSRC”) by way of a services agreement to manage the Website (as defined below in paragraph 2.1). You are entering into these T&Cs with Legends.
1.2. This Website (as defined below in paragraph 2.1), is a channel for customers to place orders for products we have available for purchase or pre-order.
1.3. You may have rights under New Zealand’s Consumer Guarantees Act 1993, and these T&C’s do not exclude any rights you have under the Consumer Guarantees Act 1993, or under any other applicable legislation in New Zealand.
1.4. If you are an Australian resident, you may also have rights under the Australian Consumer Law, and these T&Cs do not exclude any rights you have under the Australian Consumer Law, or under any other applicable state/territory legislation in Australia.
1.5 While we endeavour to ensure the functionality of our Website (to the maximum extent permitted by applicable laws, including the Australian Consumer Law):
1.5.1 we in no way guarantee uninterrupted access to our Website or the security of our Website.
1.5.2 we disclaim liability for any damage whatsoever, including without limitation direct, indirect, incidental, special, punitive or consequential damages and / or loss of profits, business interruption or loss of data or information that may result from access to our Website and the use of all or part of the elements or information contained on our Website, save for (i) death or personal injury arising from Legends’ negligence; (ii) Legends’ fraud or fraudulent misrepresentation; (iii) Legends’ wilful or grossly negligent behaviour; or (iv) for any liability under a jurisdiction’s applicable product liability legislation.
1.5. Illustrations and photos contained on our Website are sample representations of the products advertised, and minor variations may occur from time to time between those sample representations and actual products.
1.6. While the information contained on the Website is believed to be accurate and current, and Legends will use reasonable endeavours to ensure the information contained on the Website is accurate and current, it is provided by Legends in good faith on an "as is" basis. To the maximum extent permitted by applicable law including the Consumer Guarantees Act 1993, Legends (including its directors, officers or employees) does not itself make any representation or warranty as to the reliability, accuracy or completeness of the information provided by its suppliers or NZSRC and contained on the Website, and does not accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information provided by its suppliers or NZSRC and contained in the Website.
2.1. The nzsuperrugby.co.nz website and online store (collectively, the “Website”) is operated by Legends.
2.2. Access and use of the Website is conditional upon your acceptance and compliance with these T&Cs. You should read them thoroughly before using our Website, or any goods and services provided through our Website (collectively, our “Services”). Your use of the Website constitutes your agreement to the T&Cs.
2.3. Legends reserves the right to amend the T&Cs at any time, and will provide you reasonable notice of any such amendment. Your continued use of the Website after any amendment becomes effective constitutes an agreement by you to abide, and be bound by, the T&Cs, as so amended. We will always publish a link to our current T&Cs from the Website homepage at shop.nzsuperrugby.co.nz.
2.4. These T&Cs shall be governed by and construed in accordance with the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand.
- Orders, Pricing & Availability
3.1. Prices displayed within this Website are shown in New Zealand dollars (NZD) and include GST where applicable. Pricing on a product detail webpage may not include delivery charges (if applicable). Please read the shipping details contained within this Website for more information regarding delivery charges.
3.2. Any order placed by you in the manner described in this Website is an offer to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this Website at the time you place your order on these T&Cs. No order shall be deemed to be accepted by us until we issue an email acceptance of the order.
3.3. Legends reserves the right to accept or reject your order for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this Website, or an error in your order.
3.5. All pricing on our Website is available online only, and is not transferable in-store, or vice versa, on occasion where pricing differs between the two.
3.6. Prices displayed on this Website are inclusive of New Zealand GST applied at the rate of 15%. You are responsible for any taxes, duties or other liabilities imposed by any government agency, including without limitation, any customs duty, goods and services taxes or any value added tax imposed on any product or services acquired or ordered by you from this Website.
- Delivery & Tracking
4.1. We deliver products via the Website worldwide. Please email us on email@example.com to enquire about a special volume order. All parcels are shipped from Auckland, New Zealand.
4.2. We endeavour to dispatch orders within 1-3 business days of you placing the order. Shipping times are estimated at between 1-6 working days within New Zealand and 5-15 working days internationally, depending on the destination of the purchase. For the avoidance of doubt, these timelines will not apply to any pre-orders of items which have not yet been released.
4.3. Orders choosing Express Post are classed as a VIP order and dispatched as soon as possible after receipt of your order. Follow the link for more information. For more urgent deliveries, email firstname.lastname@example.org and we will endeavour to help you to make it happen.
4.4. We suggest delivery direct to your home or workplace as goods are required to be signed for. NZ Post (standard) and DHL (express) do not leave parcels at unattended premises, all parcels will be carded and taken back to the local post office. Delivery to a street address is preferable as most post office boxes are not sufficient in size to accommodate orders and/or the goods cannot be signed for.
4.5. In the event that our carrier is unsuccessful in delivering to you on more than one occasion, the parcel may be returned to our warehouse. In the event that this occurs you will be liable for any reasonable additional freight charges and/or taxes incurred to resend your parcel.
4.6. Delivery lead times are estimated as accurately as possible. Legends will not be held liable for third party delays including but not limited to carrier delays, natural weather events, peak freight periods, country’s customers (export/import) clearance requirements etc. No compensation will be paid in the event of delivery deadlines being exceeded.
4.7. Goods delivered within New Zealand will be sent via express or standard delivery. You will receive an email to confirm your goods have been shipped and parcel tracking information so you can check your parcels whereabouts.
4.8. Goods delivered internationally will be sent via [DHL]. You will receive an email to confirm your goods have been shipped and parcel tracking information so you can check your parcel’s whereabouts.
- Delivery Charges
5.1. Where applicable, freight will be charged in accordance with the Shipping section of our Website, unless otherwise stated.
5.2. Free freight offer is not applicable to Express Post or international deliveries.
5.3. Deliveries of large/bulky orders may incur additional charges. We will contact you in such an event to discuss increased shipping costs.
5.4. Please note that each individual country has different customs and duty charges, it will be the responsibility of the receiver to pay for these charges. Goods will not be released by the carrier until the charges have been paid in full. It would be prudent to check with local authorities to ascertain the charges, or Google Duty Tax calculator for a particular country. Deliveries of large/bulky orders may incur additional charges. We will contact you in such an event to discuss increased shipping costs.
6.1. Payment is required at the time of purchase and placement of your order. Payment is charged/debited at the end of the complete check-out process. You will not be charged prior to the final step and can choose not to proceed at any time before payment is taken.
6.2. We accept payment via Visa, Mastercard, and gift vouchers that are valid for use on the Website (“Gift Vouchers”). You must comply with the applicable terms & conditions of these providers.
6.3. All International orders are charged in New Zealand dollars (NZD) with the exchange rate being determined at the time of the gift / debit / credit card authorisation. Prices listed at the time of checking out include any applicable GST. Purchases delivered internationally are not subject to GST. Credit card payments will be processed in the name of [Legends NZ Limited].
6.4. Gift Vouchers should be treated like cash. Lost or stolen Gift Vouchers will not be replaced or refunded. Gift Vouchers are not redeemable for cash and cannot be exchanged. The Gift Voucher is partially redeemable and can be used over multiple purchases. Gift Vouchers will automatically expire 3 years (36 months) from the issue date or until no amount remain on the Gift Voucher. Any unused amount after the expiry of the voucher will not be available for use. The Gift Voucher can only be redeemed on the Website.
6.5. Only 1 Gift Voucher can be used per transaction.
- Risk and Title
7.1. Legends will retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you upon their delivery to or collection by a postal or courier service.
7.2. You should consider whether you need to obtain any suitable insurance.
- Returns, Refunds and Exchange
8.1. Your complete satisfaction is important to us; if you are not satisfied with your purchase for any reason, we will happily exchange or issue a credit note to the amount of the returned items, however you must contact us within fourteen days of the receipt of your order, or 30 days from receipt in the event of a return for any faults.
8.2. Where possible, items returned for exchange should be returned in the same condition as they were sent, in the original packaging, labels intact and the item unused and unworn. We reserve the right to refuse items which are not faulty and are not returned in a good condition and we will not refund any item that is not faulty and has been damaged, worn, washed or had the labels removed.
Returns and exchanges must be mailed by registered post at your expense to
Legends NZ Limited, 12 Barrhead Place, Avondale. Auckland 0600, NEW ZEALAND. We cannot accept any liability for goods lost in transit. Credit notes or exchanges will only be given on the item value; delivery charges for any item that is not faulty are not refundable. An additional delivery cost may be charged for exchanged items. We shall refund your order following receipt of, and inspection by, us of returned items (provided the return is in accordance with this clause 8).
8.3. We shall reimburse the items returned in accordance with the conditions stipulated in clause 8.1 using the same method originally used by you to pay for the purchase unless it is agreed to reimburse by any other method. The reimbursement shall be made by us within a maximum period of seven (7) working days following from the date on which we have received and processed the returned items.
8.4 Please choose your apparel and heat pressed personalisation carefully as no refund or exchange will be offered on products that have had numbers/names pressed onto them unless they are faulty.
8.5. Under the Consumer Guarantees Act 1993 in New Zealand, there are guarantees which relate to goods that cannot be excluded. You are entitled to a replacement or refund for a major failure with goods and compensation for any other reasonably foreseeable loss or damage. A product will have a major failure if it:
- has a problem that would have stopped someone from buying the item if they had known about it;
- is not of acceptable quality as it is unsafe;
- is a faulty good that cannot be remedied;
- is substantially unfit to do what it is supposed to do;
- is significantly different from the sample, image, or description; or
- does not do what we said it would, or what you asked for and cannot be easily fixed within a reasonable time period.
You are also entitled to have the goods repaired or replaced and compensation for any other reasonably foreseeable loss or damage if the goods fail to be of acceptable quality or fails to comply with any other guarantee set out in the Consumer Guarantees Act 1993 and failure does not amount to a major failure. For the avoidance of doubt, nothing in these T&Cs is intended to exclude, modify or restrict, or have the effect of excluding, restricting or modifying the application of the non-excludable consumer guarantees which consumers are entitled to under the Consumer Guarantees Act 1993. Please keep your proof of purchase– e.g. your receipt.
- Cancellations and Loss or damaged in transit
9.1. You must contact us at email@example.com immediately if you wish to cancel your order. If your order has not been dispatched, we will cancel and refund your order. If your order has been dispatched before you attempt to cancel it, clause 8 above will apply.
9.2. Legends uses reliable mailing services however mishaps do occur. All items are checked thoroughly before packaging with care. Should a package be delayed, arrive damaged or not at all, please contact us promptly by email or phone so we can discuss the issue.
9.3. To the maximum extent permitted by applicable law including Consumer Guarantees Act 1993, Legends will not be held accountable for items that are damaged or lost during transit and no refunds or credit notes will be provided for items which are lost or damaged in transit. For this reason, we use delivery processes that are traceable.
- Intellectual Property
10.1. You acknowledge that the copyright in the Website, the software, design, text and graphics comprised in the Website, the selection and layout of the Website and the content and materials on the Website (together, the 'Materials') are owned by or licensed to us.
10.2. You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public any material without our prior written consent; and must not frame or embed in another website any of the material appearing on this Website without our prior written consent.
10.3. You may store a reproduction of the content on this Website on your local computer for the sole purpose of viewing the content and materials; and print hard copies of the content and materials for the sole purpose of viewing and purchasing products but not for any other use, including commercial use
10.4. This Website contains registered trademarks and other trademarks which are protected by law. You must not use any of the marks or trademarks appearing on the Website or our name or the names of our related bodies corporate without our prior written consent. You must not use any of the other company, product or services marks on the Website that are owned by other third parties (including our suppliers) without obtaining the relevant third-party owner’s consent.
12.2. You may not have more than one active account, and your account is non-transferable. You may update, edit or terminate your account at any time through our Website.
12.3. If you choose to use a workplace email address for your account or to access our Website, then you are solely responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address and your workplace facilities.
